Dear Councilman Kates:

The Louisiana Board of Ethics, acting as the Supervisory Committee on Campaign Finance Disclosure, at its October 9, 2003 meeting, considered your request for an advisory opinion concerning the propriety of your use of campaign contributions to donate funds to the City of Bogalusa to be used for lighting of the Davis Street Ballpark. You stated that the ballpark is owned by the city and located in your council district.

The Board concluded, and instructed me to inform you, that the Campaign Finance Disclosure Act would not prohibit the donation you described. The Board specifically reviewed the provisions of Section 1505.2I of the Act which allows the use of campaign funds to make a charitable contribution as provided in 26 USC 170(c). Because 26 USC 170(c) defines a contribution to a political subdivision to be used for public purposes as a charitable contribution, the donation you described is an allowable use of campaign funds. The Board issues no opinion as to laws other than the Campaign Finance Disclosure Act.
