Re: Ethics Board Docket No. 2010-777

Dear Mr. Cormier:

The Louisiana Board of Ethics, in its capacity as the Supervisory Committee on Campaign Finance Disclosure, at its October 15, 2010 meeting, considered your request for an advisory opinion as to the Board’s interpretation of Section 1491.1E of the Campaign Finance Disclosure Act.

The Board concluded, and instructed me to inform you, that you are required to submit a check drawn from the committee’s account for the $100 fee for the Statement of Organization. LAC 52I, rule 1603A provides that a fee of $100 shall be remitted to the supervisory committee with each statement of organization required to be filed by a political committee. LAC 52I, rule 1603C provides that all fees paid in compliance with Section 1603 shall be by check drawn upon the designated depository of the political committee. Further, Section 1491.4D states that the chairman of each political committee shall designate one or more banks as the campaign depository of the committee and shall deposit any contributions received into an account maintained at such depository. No expenditures shall be made by any political committee, except by check drawn on such account or accounts.

This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as presented may result in a different application of the provisions of the Code of Governmental Ethics. The Board issues no opinion as to past conduct or laws other than the Code of Governmental Ethics. If you have any questions, please contact me at (225) 219-5600 or (800) 842-6630.
