Re: Ethics Board Docket No. 2009-329
Dear Mr. Garcia:
The Louisiana Board of Ethics, acting as the Supervisory Committee of the Louisiana Campaign Finance Disclosure Act, at its April 29, 2009 meeting, considered your response to the Board’s Notice of Delinquency letter advising you of your failure to file a personal financial disclosure statement pursuant to LSA-R.S. 18:1495.7 within 10 days of your qualifying for the office of Jefferson Parish School Board, District 4. The period for qualifying was between February 11, 2009 and February 13, 2009. You stated that you withdrew from the election on February, 18, 2009.
The Board concluded, and instructed me to inform you, that LSA-R.S. 18:1495.7 of the Louisiana Campaign Finance Disclosure Act would not require you to file a personal financial disclosure statement within 10 days of qualifying for office since you withdrew from the election prior to the expiration of the 10 day period. However, the Board concluded, and instructed me to inform you, that had you not withdrawn from the election prior to the expiration of the 10 day period, you still would have been required to file the personal financial disclosure statement pursuant to LSA-R.S. 18:1495.7.
The Board issues no opinion as to laws other than the Campaign Finance Disclosure Act and the Code of Governmental Ethics. If you have any questions, please contact me at (800) 842-6630 or (225) 763-8777.
