Dear Mr. Fanning:

At its July 29, 2009 meeting, the Louisiana Board of Ethics (“Board”) considered your request for an advisory opinion regarding whether the members of the Jefferson Parish School Board can pay for any expenses incurred in preparing personal financial disclosure reports out of campaign funds.

La. R. S. 18:1505.2(1) provides that contributions received by a candidate or political committee may be used for any lawful purpose, but not for personal use unrelated to holding public office. Advisory Opinion 2008-326 held that campaign funds could be used to pay for legal fees incurred in connection with a Legislative Auditor’s investigation. Advisory Opinion 2009-543 held that campaign funds could be used for professional expenses incurred in connection with Financial Disclosure Law compliance. Based on the foregoing, the Board concluded, and instructed me to inform you, that expenses for preparing personal financial disclosure reports can be paid from campaign funds.

This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as presented may result in a different application of the provisions of the Code of Ethics. The Board issues no opinion as to past conduct or as to laws other than the Code of Governmental Ethics.
