Dear Mr. Engle:

The Louisiana Board of Ethics, at its April 8, 2004 meeting, considered an investigation report regarding the Republican State Leadership Committee’s failure to register as a political committee and to file campaign finance disclosure reports.

The Board, by a majority vote of its membership, ordered that a public hearing be conducted for the purpose of exploring the following:

CHARGES
1.
That the Republican State Leadership Committee may have violated Sections 1491.1 and 1505.1D of the Campaign Finance Disclosure Act (“CFDA”) (La. R.S. 18:1491.1 and 1505.1D) by failing to register as a political committee for the year 2003.
2.
That the Republican State Leadership Committee may have violated Section 1505.1A and/or B of the CFDA (La. R.S. 18:1505.1A and/or B) by failing to file the campaign finance disclosure reports required of political committees by the provisions of Section 1491.6 of the CFDA (La. R.S. 18:1491.6) for the October 4, 2003 primary election based upon its opposition to the candidacy of Charles Foti, a candidate for Attorney General in that election.
Or, In the Alternative,
That the Republican State Leadership Committee may have violated Section 1501.1of the CFDA (La. R.S. 18:1501.1) by failing to file the campaign finance disclosure reports required for the October 4, 2003 primary election based upon its expenditures in opposition to the candidacy of Charles Foti, a candidate for Attorney General in that election.

The hearing will be held in the Louisiana Housing Finance Agency Building Board Room, 2415 Quail Drive, 1st Floor, Baton Rouge, Louisiana on August 12, 2004 at 9:00 a.m.

This public hearing will be conducted in accordance with the procedural requirements set forth in R.S. 18:1511.4C, the Administrative Procedure Act, and in conformity with the Rules adopted by the Board, a copy of which is enclosed.

In addition to the possible $200 per day penalties for late disclosure reports, at the conclusion of this public hearing, the Board may impose the civil sanctions of up to $10,000 as per R.S. 18:1505.4A(4).

In order to fully cooperate with you in this matter, we will, upon request, provide you with copies of all documents we may introduce into evidence and the names and addresses of all witnesses we intend to call. If you desire the attendance of any witnesses, the Board can issue subpoenas for those witnesses. In order to have subpoenas issued you must, at least ten (10) days in advance of the hearing, supply the names and addresses of the persons to be subpoenaed and state the reasons that their testimony will be relevant and material.
