Dear Mr. Coenen:

The Louisiana Board of Ethics, at its March 13, 2002 meeting, considered your request for an advisory opinion concerning Michael L. Thompson, the Executive Director of the Poverty Point Reservoir District. You stated that Mr. Thompson is considering retiring or resigning from his position and serving as a consultant for a non-profit economic development corporation to be created to build a golf course north of Poverty Point Lake. You indicated that creation of the corporation would be pursuant to R.S. 33:9020, et seq. and would require participation by the Reservoir District for its creation.

The Board concluded, and instructed me to inform you, that Mr. Thompson should avoid participating in Poverty Point Reservoir District actions involving the proposed non-profit economic development corporation while he is negotiating for future employment with that corporation. Section 1112B(4) of the Code would prohibit such participation. The Board further concluded that after leaving his position as Executive Director, Mr. Thompson may accept employment or a contract with the corporation, but he is prohibited by Section 1121A of the Code from assisting the corporation in transactions with the District for two years after termination of his public service. You explained that such assistance would not be necessary since the District will have no authority over the construction of the golf course.
