Dear Ms. Manda:

The Louisiana Board of Ethics, at its August 20, 2010 meeting, considered your request for an advisory opinion as to whether a member of the Ascension Parish Fire Protection District #1, who also serves as a volunteer fire chief, may participate in the Volunteer Incentive Pay Program. You stated that the Ascension Parish Council and the Ascension Parish Fire Protection District #1 approved this program. You also stated that the President of the Fire Department would approve all payments, not the fire chief.

The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics would prohibit the volunteer fire chief, who also serves as a member of the Ascension Parish Fire Protection District #1, from participating in the Volunteer Incentive Pay Program. Section 1123(1) of the Code only allows the participation of a volunteer fire chief on the Ascension Parish Fire Protection District #1 if no compensation is received for such service as fire chief.

This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as presented may result in a different application of the provisions of the Code of Ethics.
