Dear Mr. Dugas:

The Louisiana Board of Ethics, at its July 15, 2011 meeting, considered your request for an advisory opinion as to whether members of the Lafayette Workforce Investment Board (LWIB #41) are required to filed annual personal financial disclosure statements pursuant to Section 1124.2.1 of the Code. Pursuant to 29 U.S.C.A. 2832, in each local area of a state as certified by the governor, a local workforce investment board shall be established. R.S. 23:2193 provides that the “chief elected officials in a workforce development area may form, in accordance with rules established by the Louisiana Workforce Investment Council, a local workforce investment board.” Pursuant to these aforementioned provisions, LWIB #41 was created by Lafayette Parish. At the time of creation, Lafayette Parish had a population of 190,503. You stated that it is expected that once the 2010 census numbers become effective, the population of Lafayette Parish will exceed 200,000.

Section 1124.2.1 of the Code requires members of a board or commission who disburse, invest, or expend $10,000 or more in funds in a fiscal year to file an annual personal financial disclosure statement by May 15th. Pursuant to Section 1124.2.1(D) of the Code, a board or commission is defined as:

The Board concluded, and instructed me to inform you, that Section 1124.2.1 of the Code would require the members LWIB #41to begin file annual personal financial disclosure statements beginning on May 15, 2012 if the population of Lafayette Parish does indeed exceed 200,000 when the 2010 census numbers become effective, irrespective that the population of Lafayette Parish was less than 200,000 at the time LWIB #41 was created by Lafayette Parish.

This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as presented may result in a different application of the provisions of the Code of Ethics.
