Dear Mr. Angelle:

The Louisiana Board of Ethics, at its August 20, 2010 meeting, considered your request for an advisory opinion as to whether Thomassee & Associates, Inc., a company owned by Philip Thomassee, the brother-in-law of Scott Angelle, may enter into a contract with the Division of Administration, Office of Facility Planning and Control, at a time when Scott Angelle serves as the Lieutenant Governor of the State of Louisiana. You stated that Philip Thomassee is married to Scott Angelle’s sister. You stated that Thomassee & Associates has been offered a professional services contract with the Division of Administration, Office of Facility Planning and Control, to install an emergency generator at the East Louisiana State Hospital.

The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics would prohibit Thomassee & Associates, Inc. from entering into a professional services contract with the Division of Administration, Office of Facility Planning and Control, while Scott Angelle serves as the Lieutenant Governor of the State of Louisiana. Section 1102(2)(a)(ii) of the Code defines “agency” for the Lieutenant Governor as the executive branch of government. Section 1113A of the Code prohibits a legal entity in which an immediate family member of a public servant owns a controlling interest from bidding on or entering into a contract, subcontract or other transaction that is under the supervision or jurisdiction of the public servant’s agency. Since the Division of Administration, Office of Facility Planning and Control, falls within the executive branch of government, Thomassee & Associates, which is owned by the brother-in-law of Scott Angelle, is prohibited from entering into a contract with the Office of Facility Planning and Control while Scott Angelle serves as the Lieutenant Governor for the State of Louisiana.

This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as presented may result in a different application of the provisions of the Code of Ethics. The
