The Louisiana Board of Ethics ( “Board”) voted to file the following charge against Robert M. Marionneaux, Jr., Respondent:
While serving as a member of the Louisiana Senate, Robert M. Marionneaux, Jr. received or agreed to receive a thing of economic value for assisting the party plaintiff in Coastal Bridge Company, LLC v. The State of Louisiana, through the Department of Transportation and Development, and Boh Bros Construction Co., LLC.
2. Senator Marionneaux’s representation of the plaintiff in the forgoing lawsuit constitutes a transaction with or an appearance in connection with a transaction with the Department of Transportation and Development, an entity within the government of the State of Louisiana, or its officials or agencies.
3. Senator Marionneaux has not at any time filed the sworn written statement described in La. R.S. 42:1111E with the Board of Ethics disclosing the representation in the aforementioned case.
4. The foregoing conduct of Senator Marionneaux constitutes a violation of La. R.S. 42:1111E.
5.In accordance with La. R.S. 42:1141C (3)(b)(iv), the Board designates Tracy M. Barker and Michael D. Dupree as the Board’s trial attorneys in this matter.
WHEREFORE, the Louisiana Board of Ethics requests that the Ethics Adjudicatory Board (a) conduct a hearing on the foregoing charges; (b) determine that Robert M. Marionneaux, Jr. has violated La. R.S. 42:1111E with respect to the foregoing count; and (c) assess an appropriate penalty in accordance with the recommendation of the Louisiana Board of Ethics to be submitted at the hearing.
