The Louisiana Board of Ethics (“Board”), after conducting a confidential investigation, finds that you, Britton Loftin, violated Section 55 of the Lobbyist Disclosure Act (LSA-R.S. 24:55). The following information obtained by the Board during the course of its investigation suggests the following:
Britton Loftin filed a Lobbying Registration form in January of 2009. Mr. Loftin was a registered lobbyist for the month of January 2009. Section 55 of the Lobbyist Disclosure Act, mandates that expenditure reports be filed with the Louisiana Board of Ethics, disclosing the expenditures made during the month of January 2009, by February 15, 2009. Section 58D(2) of the Lobbyist Disclosure Act indicates that any person whose registration or report is filed eleven or more days after the day on which it was due shall be assessed, in addition to any late fees, a civil penalty not to exceed ten thousand dollars. In this case, Mr. Loftin’s expenditure report due on February 17, 2009 and was filed 29 days later than the statutory deadline.
Due to Mr. Loftin filing his January 2009 Lobbyist Expenditure Report due on February 17, 2009, 29 days late, Mr. Loftin violated Section 55 of the Legislative Lobbyist Disclosure Act. The Board further concluded that, in accordance with Section 58D(2) of the Lobbyist Disclosure Act, that Mr. Lofting be fined $300 for the violation, of which the entire amount is to be suspended based upon his future compliance with the Lobbyist Disclosure Act.
