Dear Mr. Smith:

The Louisiana Board of Ethics, during the course of its May 15-16, 1997 meeting, considered your request for an advisory opinion regarding the effect on the non-profit status of Bayou Industrial Maintenance ("BIMS") if BIMS joins the Louisiana Association of Business and Industry ("LABI").

The Board concluded, and instructed me to inform you, that the Lobbyist Disclosure Act does not address the effect that joining LABI has on a company's non-profit status. The Lobbyist Disclosure Act defines a lobbyist based on a person's activities and expenditures, not by his association with other lobbyists.
