Dear Mr. Seal:

The Board of Ethics, at its March 15, 2001 meeting, considered a staff report regarding your failure to file the lobbying expenditure report due by February 15, 2001.

The Board, by a majority vote of its membership, at its March 15, 2001 meeting, ordered that a public hearing be conducted for the purpose of exploring the following:

CHARGE

That Terry Seal, a registered lobbyist in 2000, may have violated Section 55B(2) of the Lobbyist Disclosure Act [LSA-R.S. 24:55B(2)] by failing to file the Lobbying Expenditure Report due by February 15, 2001 and covering the reporting period of July 1, 2000 through December 31, 2000 and is therefore subject to civil penalties of $50 per day until the report is filed.

The hearing will be held at 9 o’clock a.m., July 19, 2001 in the Louisiana State Retirement Systems Building, 8401 United Plaza Boulevard, 4th Floor, Baton Rouge, Louisiana.

This public hearing will be conducted in accordance with the procedural requirements set forth in Section 58 of the Lobbyist Disclosure Act [LSA-R.S. 24:58], Sections 1141E and 1143 of the Code of Governmental Ethics [LSA-R.S. 42:1141E and 1143], and in conformity with the Rules adopted by the Board, a copy of which is enclosed.

At the conclusion of this public hearing, the Board may impose additional civil sanctions of up to $10,000 as per Section 58D(2) of the Lobbyist Disclosure Act [LSA-R.S. 24:58D(2)].

In order to fully cooperate with you in this matter, we will, upon request, provide you with copies of all documents we may introduce into evidence and the names and addresses of all witnesses we intend to call. If you desire the attendance of any witnesses, the Board can issue subpoenas for those witnesses. In order to have subpoenas issued you must, at least ten (10) days in advance of the hearing, supply the names and addresses of the persons to be subpoenaed and state the reasons that their testimony will be relevant and material.
