Dear Ms. Reeder:

The Board of Ethics, at its May 13, 1999 meeting, considered your request for an advisory opinion regarding whether you are required to register as a lobbyist if your activities consist solely of talking to legislators about various issues.

The Board concluded, and instructed me to inform you, that you are not required to register as a lobbyist if your activities consist solely of talking to legislators about various issues. LSA-R.S. 24:51(5) defines a “lobbyist” as “any person who is employed to act in a representative capacity for the purpose of lobbying” or “any person who receives compensation of any kind to act in a representative capacity when one of the functions for which compensation is paid is lobbying” and “who make expenditures of $200 or more in a calendar year for the purpose of lobbying.” However, as there are bills in the current legislative session to change the definition of “lobbyist,” you may want to contact the Board or its staff at a later date to determine whether or not you are required to register as a lobbyist.
