Dear Ms. Thierry:

The Louisiana Board of Ethics (“Board”), after conducting a confidential investigation, finds that you, Monique Thierry, violated Section 55 of the Lobbyist Disclosure Act (LSA-R.S. 24:55). The following information obtained by the Board during the course of its investigation suggests the following:

Monique Thierry was a registered Louisiana Lobbyist for the year of 2008. Ms. Thierry filed her 2008 Lobbyist Expenditure Report, due August 15, 2008, 24 days late. The Report was filed late because the certified letter was signed by a Chamber employee who did not notify Ms. Thierry that she had received the notice of delinquency. Upon Ms. Thierry was given the notification, she contacted the Board to inquire whether her faxed reports of August 15, 2008 had been received. The Board did not receive Ms. Thierry’s faxed copies of August 15, 2008. Ms. Thierry then resubmitted her August 15, 2008 expenditure report. Ms. Thierry’s information with the Board has been updated to ensure future compliance with the Lobbyist Disclosure Act.

During 2008, Section 55 of the Lobbyist Disclosure Act, mandated that expenditure reports be filed on August 15, 2008, disclosing the expenditures made during the period of January 1, 2008 through June 30, 2008. Additionally, Section 58D(2) of the Lobbyist Disclosure Act indicates that any person whose registration or report is filed eleven or more days after the day on which it was due shall be assessed, in addition to any late fees, a civil penalty not to exceed ten thousand dollars. In this case, Ms. Thierry’s expenditure report due on August 15, 2008 was filed 24 days later than the statutory deadline.

Due to Ms. Thierry’s filing her 2008 Lobbyist Expenditure Report due on August 15, 2008, 24 days late, Ms. Thierry violated Section 55 of the Lobbyist Disclosure Act. The Board further concluded that, in accordance with Section 58D(2) of the Lobbyist Disclosure Act, Ms. Thierry be fined $300, of which the entire amount is to be suspended based upon Ms. Thierry’s future compliance with the Lobbyist Disclosure Act.
