Dear Mr. Mouton:

The Louisiana Board of Ethics, at its December 15, 2004 meeting, considered your request for an advisory opinion concerning whether you, as a member of the Louisiana Department of Wildlife and Fisheries Commission, need to register as an executive branch lobbyist if you have communications with the Governor’s staff concerning issues related to your agency.

The Board concluded and instructed me to inform you do not have to register as an executive branch lobbyist if you communicate with members of the Governor’s staff on issues related to your agency. LSA-R.S. 49:73 excludes elected officials and appointed public officials acting in the performance oh his public duties from being considered a lobbyist. Therefore, you do not need to register as an executive branch lobbyist. However, the prohibitions contained in LSA-R.S. 24:56E are still applicable, and you are not allowed to lobby for or against any mater intended to have the effect of law pending before the state legislature or any committee thereof.
